Terms of Service

1. Acceptance of terms

These Terms of Service (the “Terms”) govern your access to and use of https://residentiae.ca and the services offered by Residentiae Real Estate (“Residentiae”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service to:

• Violate any applicable law or regulation;
• Scrape, harvest, or collect data from the Service except as expressly permitted;
• Interfere with or disrupt the integrity or performance of the Service;
• Misrepresent your identity or affiliation, or infringe the rights of others.

3. Property information & accuracy

Listings, neighbourhood content, demographics, permit data and other information are provided for general informational purposes and are sourced in part from third parties, including Neighbourly. While we strive for accuracy, we do not warrant that such information is complete, current or error-free. You should independently verify any information before relying on it, and engage qualified professionals for any real estate transaction.

The trademarks REALTOR®, REALTORS®, MLS®, Multiple Listing Service® and associated logos are owned or controlled by The Canadian Real Estate Association (CREA) and identify the real estate professionals who are members of CREA and/or the quality of services they provide.

4. Agent subscriptions

Agents may subscribe to become a Neighbourhood Expert for a flat fee per location, subject to availability and a separate subscription agreement. Subscriptions do not constitute an employment, agency or partnership relationship with Residentiae, and we make no guarantee as to the number or quality of leads or any particular business outcome.

5. Intellectual property

The Service, including its design, text, graphics and software, is owned by Residentiae or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute or create derivative works without our prior written consent.

6. Third-party links & data

The Service may contain links to, or data from, third parties, including Neighbourly. We are not responsible for the content, policies or practices of third parties, and your use of third-party services is at your own risk.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free.

8. Limitation of liability

To the fullest extent permitted by law, Residentiae and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of or relating to your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Residentiae and its affiliates from any claims, liabilities, damages and expenses arising out of your use of the Service or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Ontario.

11. Changes to these terms

We may revise these Terms from time to time. The “Last updated” date above reflects the most recent changes. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
